The basic reason for this is that they're using something an compatibility/translation layer instead of plain emulation (which would require much higher resources) or native BC. In this scenario, the "emulated" system is granted additional processing power, so reduced loading times and stabilized performance are in fact possible. It's probably way better than using parts of the old hardware in it anyway, as you'll get improved performance instead of the same mediocre performance that plagued certain games.
Also, all first-party games are backwards compatible with the sole exceptions of titles that can work on the new console but absolutely require the OG Joycon (and not the Joy-Con 2 controllers included with Nintendo Switch 2) in order to play

In case of third-parties, Nintendo is actively doing compatibility tests with the partnership help of the respective studios. But since there is a massive amount of games present on the market and Eshop, it's a challenging task so they only confirmed a 20% without any flaws and somewhere around 5% of titles with issues. Nintendo does seem to care enough for third-parties to work on the BC, according to the pdf files, which even include niche titles like Senran Kagura Reflections, licensed Touhou fangames, Nippon Ichi Software titles amongst others.

That is said, I don't expect Nintendo to care about the actual shovelware polluting the Eshop, the likes of Hentai AI Girls or whatever Unity rejects. Hence the previous disclaimer.
